Operating an electric scooter or bicycle with electric assist
Effective April 2020 – the law allows people to operate bicycles with electric assist (e-bikes) on some streets and highways in New York State.
Effective August 2, 2020 – the law allows people to operate electric scooters (e-scooters) and bicycles with electric assist (e-bikes) on some streets and highways in New York State.
- Electric scooter – a type of device with handlebars, a floorboard or a seat, and an electric motor that can be powered by the electric motor and/or human power.
- Bicycle with electric assist – multiple classes of bicycle with an electric motor and operable pedals. A bicycle with electric assist doesn’t qualify for a registration as a motorcycle, limited use motorcycle, moped or ATV and doesn’t have the same equipment.
You can operate an electric scooter or bicycle with electric assist on some streets and highways in New York State:
- you can operate these devices on highways with a posted speed limit of 30 MPH or less;
- municipalities can further regulate the time, place and manner of operation of these devices;
- you cannot operate these devices on a sidewalk except as authorized by local law or ordinance.

NEWS: August 25, 2023 An e-scooter rider heading north in the bike path on Church Street in Tribeca, NYC collided with a car and was critically injured at around 10:45 a.m., as the driver made a left turn from Church Street onto Thomas Street.
The NYPD’s preliminary investigation determined that “a 43-year-old male operating a 2010 Volkswagen Jetta was travelling northbound on Church Street, making a left turn into westbound Thomas Street. Concurrently, a 41-year-old male operating a Kaabo Mantis e-scooter (standing) was also travelling northbound on Church Street in a marked bicycle lane.
“As the Jetta was completing the left turn, the e-scooter operator braked and lost control of the scooter. As a result, the e-scooter operator was ejected over the handlebars of the scooter and collided head first into the driver side rear wheel of the Jetta. EMS responded and removed the e-scooter operator to NYC Health and Hospitals/Bellevue in critical condition with severe head trauma. The operator of the Jetta remained on scene and did not sustain any injuries.”
The NYPD’s Highway Collision Investigation Squad investigated the collision. An officer at the scene told reporters there that he blamed the accident partly on the curbside structure just down the block, since it hinders views of the bike lane, but the driver also had dozens of speeding tickets on his record.
